As an intellectual property attorney, I love AI for its efficiency and versatility.
It has helped me streamline processes, improve client communications, and even brainstorm new ideas.
But there's a fine line between using AI as a tool and relying on it to create original content.
A client recently asked me if they could copyright a lead magnet they generated with ChatGPT, and that's when I realized just how critical it is to understand the nuances of AI-generated content and intellectual property protection.
AI and Copyright—A Strict Line in the Sand
The U.S. Copyright Office has made it clear: AI-generated content, with limited exceptions, does not qualify for copyright protection.
This is because copyright is intended to encourage creativity and originality among human authors.
The policy ensures that creators can be held accountable and that their rights are protected.
If you're writing a book, course, or presentation using AI tools like ChatGPT, you need to understand that the content may not be eligible for copyright protection.
And if it is not eligible for Copyright protection, others can copy and sell your content freely without compensation, authorization, or acknowledgement.
This is a crucial point for thought leaders who want to protect their intellectual property.
Trademarks and AI—Distinctiveness and Confusion
When it comes to trademarks, the rules are slightly different.
Trademarks protect brands, slogans, logos, and other elements that differentiate your goods or services from others in the market.
The U.S. Patent and Trademark Office (USPTO) requires that a trademark be distinctive and not confusingly similar to existing trademarks.
Here's the catch: AI-generated content relies on patterns and vast amounts of data, which means it might inadvertently create something that resembles an existing trademark.
If your AI-generated logo or slogan is confusingly similar to another brand, you could be facing a trademark infringement issue.
Thus, while it’s entirely possible to get AI generated content trademarked, AI’s reliance on input content may subject your outputs to possible suit.
